In Western Pa there is a lot of fighting going on over the last 10 years concerning "abandoned" ROWs, even ones that have legally been railbanked. There have been incidents of a##holes who sabotaged bulldozers, pulled up rail, strung heavy fences across the ROW, even some who took pot shots at hikers and bikers. Their rational? They don't want strangers in their neighborhoods "wandering off the trail and peeking in windows". Where some local business has tried to put back a siding, or a spur, they fight it because of the "increase in noise, dirt, and traffic". Actually, I do know of one family who has legally beaten the government They still had a copy of the original writ of seizure, which stated that the property would revert 10 years after abandonment. (I think the state is appealing.). The rest are hoping that they can stall the process long enough that the govt loses interest.
