Lets put a few things in fact.
1) State of Colorado has a BOILER LAW. Unless its a copper tube boiler IT WILL require a yearly inspection!! Does not matter if its a welded Boiler or not. The Loop property is exempt from FRA at this time, so State Law applies!
2) The ASME Boiler Code DOES allow for a new fabrication of a rivited boiler. ( Just ask the Cass RR ) to Section 1 for Power or High Pressure boiler. Requirement is The ASME Certificate holder must have a copy of the 1974 ASME Section 1 and other references in their quality control program manual. Its the last Boiler Code Book with Rivit calulations.
3) As for radius of tube sheets they can be built that way. Difference is the Boiler Code of today does not allow for the tight radius found in the # 9 or other steam locomotives.
Now for a rough guess on cost. With jump in steel prices over the past few months. Third party inspection cost, x-ray of welds, possible post weld heat treating, its possible that a new boiler for # 9 having all documentation required by Code includings engineering drawings and calulations I would say $450,000 min.
