The existence of one grade crossing may make your Tweetsie line non-insular but that does not require FRA inspection. Non-insular description only makes it legal if the FRA wants to extend jurisdiction over your line. Please note that in forming the new laws, I quote "The FRA is very careful in exercising its enforcement discretion where these smaller entities are involved." (report to Congress 6/11/1996) "The Agency is sensitive to the fact that tourist railroads are often financially strapped and dependent on volunteer labor. Therefore, FRA's practice is to work with them to ensure safety in their operation" (Same). Exercise of jurisdiction requires the need for safety. This is why the East Broad Top in not under jurisdiction. PRR
