Actually, if you go read the STB rulings on this, I think that you will find that Mr. Shank pretty much won the battle, and that Creede really can't do much. I suspect the lack of recent action is due either to Mr. Shank focusing on other activites or disgust with respect to Creede's behavior.
The line technically has never been abandoned and is connected to the national transportation system. STB jurdistiction trumps state/local jurdistiction -- so Creede can't take RR property or restrict activity. They could apply for adverse abandonment, but I don't think that they have sufficient grounds for that to be granted by the STB.
