With so many topics and threads I do not remember which one contained a statement that CHS doesn't know how to get out of the contract with Railstar or something like that.
From what I understand the contract as offered during the original bidding process is basically non-existent. Railstar was supposed to bring equipment to the table, they didn't. At one time they made reference to brand new cars being built. Then those were sent somewhere else but others would be built, what happened to that? Many of the points that GLRR held as not making the offer profitable to them have just disappeared.
Why would the GLRR have passed on this offer to remain at the loop? Just tell us what you spend and we will pay you back? Isn't that the way it supposedly runs right now with Railstar and CHS? An offer like that would surely have made GLRR money as they would have no expenses and no longer pay a fee to operate.
CHS made illegal modifications and changes in the contract with Railstar after the GLRR was out of the picture and that should be the basis of all action to hold CHS responsible, remove Railstar and call for a correct and legal review of operations and the development of a proper proposal for an operator. Then if Railstar or anyone else chooses to bid and the process is conduted without prejudice we might see this issue finally start to be resolved.
