I have followed this horror story closely, since some land shark tried to get me off my property so he could improve access to his proposed 300 half-acre "ranchesttes". The good news is my county commissioners have stated publicly and to me personally that they "categorically do not condemn land to help out developers". The best part was when the developers were reduced to begging me to cooperate, even as they offered almost nothing in return! Those chiselers!
One aspect of this story that is a common thread is the municipalities that back such schemes are broke and desperately looking for new revenue sources. The court in their decision pointed out that railroads were big users of eminent domain laws. God bless Justice Sandra Day O'Connor for her dead-on condemnation of today's ruling. She should be the next Chief Justice, if this world was at all fair!
