I don't know about false advertising. They had to put something on the brochure, and certainly couldn't use a shot of former GLR equipment. For continuity's sake, they had to get a brochure out as soon as possible, before they even have finalized a deal on rolling stock. An historic photo is probably about the only choice they had.
I'm sure there were several people along the way to printing that should have caught the spelling errors, though! Shame on them.
