Just an observation as the CHS races to get equipment for the Loop ready; they have potentially created a very interesting legal liability for themselves. Remember part of the reason for booting the GLRR was the increase in insurance the CHS demanded. Now the CHS decides to be responsible for obtaining and restoring operating equipment, so who is on the hook then if the equipment is unsafe for this operation? CHS? Railstar? Ulrich? Or maybe CHS can blame the Ashby’s because they took their trains away and left CHS holding the bag. LOL Can Railstar refuse to operate CHS provided equipment if they deem it unsafe? If there is an accident an attorney will have a field day with them, just remember the old law school rule “go for the deepest pocket”. The CHS pockets are bottomless because guess what, they can just go to the public’s wallet to foot the bill for their ignorance. Colorado folks bend over, me thinks the CHS isn’t done with you yet.
