There is no dispute as to who owns the D&RGW #223. You can read a summary of this situation in an earlier (2020) NGDF thread posted here:

It is in the Utah State Historical Society's purview to decide what they are going to do with #223 and probably best to let the parties with interest in this project do their lobbying offline.

The NGDF was started by Don Richter and is currently operated in his memory by Nathan Holmes and others.
