Just having skimmed through it, the main catch that would put a crimp in the ability to run a late night train on a tourist railroad would be just a scheduling issue.
If employee initiates an on-duty period each day for six consecutive calendar days including at least one ‘‘Type 2’’ assignment (generally, those including time on duty between 8 p.m. and 4 a.m.) employee must have 24 consecutive hours off duty at the employee’s home terminal.
I could foresee "We're not going to run an evening train, because we cant afford to have someone to take off 24 hours off during the middle of tourist season and we're short handed!"
