The Galloping Goose Historical Society of Dolores has investigated a route into Lost Canyon but all the land is now privately owned as the RGS never bought it originally. The owners refused access. Some of the land is also owned my Native Americans and now considered part of heritage without a railroad.
Therefor they looked the other way and found the old right or way is on the sholder of the present highway. Initially there was a legal ruling that their operation would fall under the Paragraph #5 of the new FRA rules describing the nature of insular and non-insular railroads, concerning their choice of extending jurisdication. Paragraph 5 is "Rapid Transit" [light rail] which will not come under FRA. Also, it was rulled that they will receive Federal monies distribution for rapid transit just as the Denver Light Rail System. [read jobs in low income area].
One of the hardest workers on the organization is Val Trusen, who owned the Ponderosa Restruant in Dolores, and also the guest ranch "The Line Camp". The entire requirement for needed rail is now piled on the property of Line Camp.
Being a Light Rail Syetem, by law, they can cross and run on the public right of way. Any railroad in this nation may cross a public right of way as they are "public" if they own land on both sides. Only states can regulate the protection required.
I do not believe Sundance Publication has ever been on line nor will they use the computer. They could never get out so many fine books if they read all of the stuff on the web.
All above is subject to error and is not a legal statement. We hope they succeed to first build from Line Camp down to Al Rust's RR junction and then go up the switchback to a outlook on the Mesa. That would give a scenic ride, 5% grade, and stay out of the center of Dolores until the Goose spreads it feathers and flys, so to speak. PRR
