I also had an idea and posed this liability question to a Commercial Marine insurance underwriter. As long as the track is maintained to the appropriate FRA standard for the type of service to be provided, then the insurance company will defend the railroad against ANY lawsuit even if the loss or damage occurs outside of land owned by the railroad.
Compensation for loss or damage may not be paid but the insurer will always defend.
