In the talks that I've had, Wally is correct.
The FRA stays away as long as the operations are deemed as safe. The FRA can exercise its federal authority on an "insular" operation if necessary.
The best way to operate is to meet or exceed the FRA mandated laws for common carriers.
Unfortunately, there are many in the Steam Tourist industry who have the same misconception as you. The House and Senate in Washington want to transform the FRA to the FRSA (Federal Railroad SAFETY Administration). If they are successful and they hire many more inspectors as planned, the tourist operators hitherto unvisited may be in for some unpleasant surprises.
The best way to keep from coming under Federal Oversight is to be safe enough to fly below the radar.
