The Loop is an "insular operation", and is currently NOT under the jurisdiction of the FRA or its regulations. They do have to keep the state boiler inspector happy, but I am not aware of any other State of Colorado agency with the authority to inspect them.
This is common to many smaller tourist operations and museum operations. As long as you don't cross a public highway or waterway, and do not perform common carrier service; the FRA currently has no jurisdicition according to 49CFR.
