Keep in mind that it isn't the railway but the lawyers hired by the railway that draw up these things. Their mandate is to "cover the client's backside" from any and all types of lawsuits. When you look at some of the ridiculous suits that have been launched and won over the years, I think you can understand the rationale behind the railway's demands in this case.
