Years back I was on a city council and we had to get permission to put a new water main under a rr ROW, whose parent company was RioGrande Pac. Corp. As I recall the draft they sent for us to sign made our city responsible for any and all damage to equipment or persons forever that could be tied to our encroachment on the ROW. This on a ROW that was class 1, in yard limits and ended up abandoned within 2 years.
