I'm not sure at what level the water has reached. The mine still maintains an office in Silverton with a resident manager, and has a contract with another company to treat the remaining water coming out of the mine. I think there are enough places for the water to seep out of the mountain that Lake Emma won't refill. One of the big delays was a resoultion of the returning flow of water to springs and seeps that the state maintained were new point sources of water discharge and that was all finally resolved.
