What is going on at UP regarding their logo and trademarks, etc., is just another example of lawyers gone beserk and management's reluctance to tell them to buzz off. This is not an unusual management versus lawyer kind of issue. Corporations do have to guard their trademarks, and the legal issues are complex. If a corporation fails to defend their trademark/logo they risk loosing it to the public domain. But railroads don't have to be as heavy handed as UP as been. As far as I can figure out what is going on at UP, it is a classic case of the lawyers taking charge. Lawyers and the law are important, but at some point some one with some business sense needs to reign them in, there are trade offs with PR, etc. The folks at BNSF seem to have figured out those trade offs pretty well. Apparently UP's instituational arrogance makes this difficult for them to accept.
