Yes, the ties must have been in BAD shape, as just before the season opened the rail contractors had evaluated the right of way and regauged about 1.5 inches over along this curve to allow the engines to easily make it through there and, as you know, all good rail contractors normally like to leave deteriorated ties in place so they can come back and fix them later after a de-rail mishap where any injured parties can sue them for negligence.
