I would think that one big advantage of FRA involvement would relate to liability. If you have complied with whatever the FRA requests, and then something happens that causes injury or death to an employee or passenger, I would think that at least you would be (somewhat) protected against any claims of negligence. The downside of course, as we found on the C&TS, is that the FRA can take a very different (and expensive) position from your own (highly qualified) track folks as to what is needed for a safe railroad. Some things are highly judgemental. But if you don't immediately kowtow, we found the FRA can get nasty. After all they are enforcers with the weight of the Federal govmint behind them. But more often than not I think the FRA will be reasonable.
