In the spirit that no detail about the ng. is too trivial to be discussed, this thread has been interesting. Based on what George Cook posted on TO (since deleted), it would appear that the C&TS has never been a common carrier by the terms of the sale agreement beween Rio Grande and the states. On the other hand, given the fact that the Motorways traffic that was presumadbly intended to be protected by the limitations against revenue freight has most likely disappeared long ago, it is unlikely that UP as successor to the DRGW would care if the C&TS carried revenue freight. So I would conclude, in the very unlikely event that anyone ever had a bonafide reason to want the C&TS to carry revenue freight, that person could make a deal with the C&TS. And it is unlikely the UP would object. So I guess theoretically it is possible for the C&TS to become a common carrier, whatever that means in todays regulatory context. But of course the chances of that ever happening are between slim and none. But who knows, maybe some contractor will want to move aggregate from Martinez Point for a giant highway project near Antonito. Those new the opinions of a bored old guy with nothing better to do.
