Actually, a railroad right-of-way (ROW) can be owned outright, meaning the railroad owns it in fee and is the underlying landowner. Or the railroad might own it as an easement, meaning they have the right to run their railroad over the land, but someone else retains the ownership. It all depends on how the original ROW was originally granted. I have seen both kinds of ROW along the D&RGW narrow gauge. I don’t know how the ROW is held in this particular location. Perhaps the more important question here is the width of the ROW.
