Other than to protect their brand against images being used in something nasty or illegal, I think railroads would welcome the free advertising. Remember a few years ago when the U.P. tried to force all of the model makers to pay them a royalty for trains made with their brand? The negative press, (and probably the legal department's estimate of what it will cost to enforce, compared to what little revenue it would generate) probably is what caused UP to drop the idea.
Whoever wrote this should have had it reviewed by a P-R person on how it would be received by people reading the rules, because it sure sounds pretty mean spirited to someone wishing to buy a ticket and to take photos and video of the trip.
