The D&S is letting RGS 5 operate in the winter and Barret was kind enough to let us know. RGS 5 only runs through the tireless efforts of the GGHS volunteers, and only runs over the D&S at their whims. Let's be a little supportive of both for putting in the hard work to make this happen (only the second winter run for #5 since the 1950s), rather than complaining about what happened in Chama ~6 years ago that has absolutely no relevance to this event. Part of what greases the skids for these things is the PR good will it generates, and if these announcements instantly degrade into the Airing of Grievances, that doesn't make anybody want to do it again.
As for the commercial use policy, I'm not a fan either, but it's right there on the webpage for this trip and it's been that way for 4-5 years now at least. You could always call and ask what would be required to license for commercial use. I know someone who did a few years back, and at least at that point, they're mostly just interested in controlling how their corporate image is used. I don't think they even wanted license fees, just a signed agreement on the specific use. As has been said, they're easy enough folks to talk to - just call them up if this is a concern and ask questions.
Personally, having gone last year, riding RGS 5 through the snow is an experience not to be missed.
