I just thought I'd add an experience I had in the 1980's.
Southern was adding a new yard just north of the Chamblee yard here in Atlanta. I was down there one day and found two spikes with no points and one with a cross-wise point like your photo shows. They were brand new (no rust). My opinion was that they were manufacturing errors - sort of like 99 and 44/100's pure will give an error rate of 56 in every 10,000.
If ties are spaced 18" apart, there are 3520 ties per mile. with 4 spikes per tie -> 14,080 spikes per mile. With 56 in 10,000 bad =>> about 79 spikes per mile in error.
FWIW. (and it could be nothing).
