IMO the driver of the truck is solely responsible for putting the trailer on those tracks. It was his/her decision to attempt a crossing without having sufficient room to clear the RoW.
Period.
The driver should be severely punished. He/she essentially murdered those people though an act of utter stupidity.
My prayers go out to the families of the victims and the railroaders that now have to live with this.
