A. First: nobody but an employee switching or about to board moving equipment (which is now a no-no on many railroads anyhow) has any business between close parallel tracks. That's a danger zone for even longtime rails.
Second: that fence is a help, but looks like the railfan is leaning on the post at the end of the fence with body on both sides of the posts. As Dan R.says, it looks like "close clearance" to me anyway.
Third: The uniformed fellow on the platform should have at least made an attempt to get the guy to move, as he obviously looked at him, then turned away.
Fourth: I was not able to tell if there was anyone in the left side of the cab; possibly somone else can see better. In any case, the man on the rear platform shuld have signalled a stop.
B. I would show this at the safety days ..... says more than a whole lotta words.
