kerfuffle

Go easyl! We don't know what kind of kerfuffle may have going on in the auto before it pushed through the gate. A grandmother with grandkids? Anything may have been happening to distract her. I know, I'm there as a grandfather. Kicking the drivers seat, screaming, crying etc. Or, she may have had a stroke. She may have been reaching for a cup of coffee and didn't see the gate. Ever heard the supposedly true story about the train that that could have stopped, but ran into a person because the engineer was reaching for a cup of coffee. Go easy my friend!
Don't call someone stupid until you have been there.
Now the act of suing, well there are lawsuits for all sorts of things, so this one is not at all surprising.
