I have said this before, and I'll say it again. Arbitration is a better way out of lose-lose court cases such as this one. There is nothing to be gained by getting a bigger hammer to squash the toes of Shank's trespassers.
There are lots of tourist railroads that operate as an out-to-the-siding-and-back train ride. Maybe Don should think of doing this soon versus fighting for the run to Creede. If Creede could use the tourists in the winter, but not all year, then he could agree to limited numbers and seasons of trains into town. Give them a taste of the good stuff and they probably wouldn't mind a few more sips later. Yet, they are to be respected for not wanting to be tourism-junkies.
But the first thing that needs to be done is a level of respect. The land-ownership problem could have been an olive branch, but instead he asks for rent from land the mayor supposedly owns. Rethink this one, guys.
