Actually, I believe by crossing a stream, they cross "Waters of the United States" which also opens it up to FRA jurisdiction, if they chose. Not that its that bad a thing... much of the regulations were set up by ARM members to help protect the tourist rail industry from wildcat operations that did not operate in a safe manner.
