Belfast, Maine in violation of Commerce Clause *LINK*

City of Belfast Maine just like the City of Washington, DC is being accused of being “‘in violation the Commerce Clause of the U.S. Constitution”. CSX has filed suit against DC for a hazardous material ban, and the B&ML RR is being barricaded from track they have eminent domain right to move over. I would hope RailStar proceeds to call the Federal Marshall’s office, and also the Attorney General of the State of Maine and read the town council the “riot act”, that being the U. S. Constitution.
Just on Tuesday night, 2/15/05, the Belfast City Council agreed to sit down with RailStar Corporation to discuss the possibilities that might reinstate RailStar ownership and/or access.
As I said before, there are a million properties in this nation where railroads operate over land they do not own, by adverse possession or by eminent domain. If each owner acted like the Belfast Town Council in barricaded that land, there would not be a railroad freight car moving a 1000 miles in this country.
