A stumbling block I see is the D&RGW was requesting to officially abandon the Silverton Branch, followed by a sale to a non-railroad entity. In reality, once abandonment was approved, there was nothing preventing the D&RGW from changing its mind and scrapping the whole thing. The whole thing about the foundation having their own locomotive, renting space in the Durango roundhouse, arranging for hostling, repairs, etc. sounds like a bad deal from the git-go.
When Bradshaw came along, he wanted to by the now-isolated branch as his intent to was operate it as a for-profit entity. The ICC/STB has less heartburn over that.
