That's super easy to fix. As long as the element "fouling" the shot is surrounded by a consistent background....in this case, the ballast, the cloning and healing tools in the Adobe Photoshop/Elements/Lightroom Products will take care of that fellow's hat in a heartbeat, and your shot will be fine.
