Lionel, Union Pacific reach trademark agreement
Lionel and the Union Pacific Railroad have reached an agreement over the use of Union Pacific logos on Lionel trains, according to court documents.
The railroad filed a lawsuit against Lionel L.L.C. in May 2004, claiming that Lionel had infringed upon its current and predecessor railroad trademarks by failing to follow the Union Pacific's product-licensing program. Lionel's entry into bankruptcy protection in November 2004 kept the lawsuit on hold for nearly two years until the agreement proposal was filed earlier this month.
The settlement, which must be approved by the bankruptcy court, calls for a licensing arrangement in which Lionel would pay the Union Pacific a royalty based on sales.
