According to Martin Chavez, Supervisor for the Carson National Forest, “the concern for our wildland urban interface communities and the decision of our neighboring Forests, the Cibola and the Santa Fe, to order Stage III Fire Restrictions and Partial Closures, the Carson has decided to go into Stage II Fire Restrictions sooner than anticipated”. These restrictions will go into effect Monday June 21, 2004 at 12:01 am. Stage II Fire Restrictions Prohibit: 1. Building, maintaining, attending or using a fire, campfire or stove fire. 2. Smoking, except within an enclosed vehicle or building. 3. Possessing, discharging or using any kind of firework or other pyrotechnic device. 4. Using an explosive. 5. Operating a chainsaw or other equipment powered by an internal combustion engine. 6. Operating or using any internal or external combustion engine with out spark arresters. 7. Welding, or operating an acetylene or other torch with open flame. 8. Possessing or using a motor vehicle off National Forest System Roads. 9. Possessing, discharging or using any kind of firework or other pyrotechnic device. Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this order: 1. Persons with a permit that authorizes actions specifically prohibited by this closure order. 2. Persons using pressurized liquid or gas stoves, lanterns, or space-heating devices provided such devices meet the fire underwriters’ specifications for safety. 3. Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty. 4. Lessees or permittees within the restricted area are exempt from prohibition 1 above, provided such fires are within their residence.
These restrictions are being implemented for public safety and because of extreme fire hazard conditions on federal lands. Violation of these regulations is punishable by a fine of not more than $5000 for an individual or $10,000 for an organization, or imprisonment for not more than six (6) months or both. It is still possible to visit, hike and camp on the Carson National Forest provided you observe the above restrictions. ORDER STAGE II FIRE RESTRICTIONS CARSON NATIONAL FOREST Pursuant to 36 CFR § 261.50(a), the following acts are prohibited on all National Forest System lands within the Carson National Forest, in the State of New Mexico. The restricted area is depicted on the attached map, hereby incorporated into this Order as Exhibit A. 1. Building maintaining, attending, or using a fire, campfire, charcoal broiler, or a coal or wood stove fire. 36 CFR 261.52(a). 2. Smoking, except within an enclosed vehicle or building. 36 CFR 261.52(c). 3. Possessing, discharging or using any kind of firework or other pyrotechnic device. 36 CFR 261.52(f). 4. Using an explosive. 36 CFR 261.52(b). 5. Operating a chainsaw or other equipment powered by an internal combustion engine is prohibited 36 CFR 261.52(h). 6. Operating or using any internal or external combustion engine without a spark arresting device properly installed, maintained and in effective working order meeting either: Department of Agriculture, Forest Service Standard 5100-1a; or Appropriate Society of Automotive Engineers (SAE recommended practice J335(b) and J350(a). 36 CFR 261.52(j) 7. Welding, or operating an acetylene or other torch with open flame. 36 CFR 261.52(i). 8. Possessing or using a motor vehicle off National Forest System Roads. 36 CFR 261.56 Except when parking in an area devoid of vegetation within 10 feet of the roadway; and except for parking overnight in developed campgrounds and at trailheads. 9. Violating New Mexico state law concerning burning, fires, or which is for the purpose of preventing or restricting the spread of fire. 36 CFR § 261.52(k). Pursuant to 36 CFR § 261.50(e), the following persons are exempt from this order: 1. Persons with a permit that authorizes actions specifically prohibited by this closure order. 2. Persons using pressurized liquid or gas stoves, lanterns, or space-heating devices provided such devices meet the fire underwriters’ specifications for safety. 3. Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty. 4. The following areas within the Carson National Forest are excluded from these restrictions: the Jicarilla Ranger District and the Cumbres & Toltec Scenic Railroad. Fireworks are always prohibited on all National Forest system lands. These restrictions are being implemented for public safety and because of extreme fire hazard conditions on federal lands. This order becomes effective at 12:01 a.m. (one minute after midnight), Monday June 21, 2004 and will remain in force until rescinded.
