Is the B&ML still a common carrier? If so, they would have to file for abandonment of any mainline track or rail service. The city (or other third party) can file with STB for an "adverse abandonment" to force the issue, but they would have to prove it was in the public's interest NOT to have the railroad in that location. Even if abandonment is approved, you have to go through the offers of assistance or purchase, or Rails-to-Trails before the track could be removed and it becomes free and clear. It doesn't matter who owns or operates it if it its being used as a common carrier (freight - passenger probably does not apply since it is a ride instead of transportation).
