This is certainly one of those old tales that was never true and just will not die. No one has ever actually shown a document to back this claim up and the indisputable fact that the BN did not raise a finger when 71 was moved to Silver Plume for operation on the Georgetown Loop in 1986 (for operation) and stood idly by when 71 ran in Central City in the late 1980's sure would seem to be enough to put this idea to rest.
The reality is that the C&S gave 71 to the county in lieu of back taxes, the C&S documents that spell this out place no conditions on what the county could or could not do with THEIR property. C&S (and successor corporation) control over 71 ENDED in 1941 when title to the locomotive was transferred to Teller County. The BN, let alone the BNSF, has NEVER had nor exercised any claim to 71.
