It's true that the current WW&F grade crossings are private but the railroad already follows some FRA rules such as logging engine crew hours and conducting bridge inspections. With these practices in place, going under FRA oversight won't be a big change to daily operation. Yes, there has been discussion of crossing either the town road going south or the state road going north so crossing a public road has not been ruled out but it would be expensive (in both construction costs and increased insurance coverage) so it won't happen anytime soon.
Here's an example of a private crossing.
