John , the comments here are all very accurate . Since all freelance artists are contractors , they retain all rights . I routinely negotiate rights with authors , publishers and restoration groups. Since the use of my art is basically a free advertisement , I make simple "gentleman's agreements",and I usually get recompensed for the cost of transparencies and and get a copy or two of the book to boot. If prints are in the deal ,I ask for a few of those to sell on my own Negotiating reproduction rights is another matter .Once in a great while a customer asks to buy all rights to a painting .That requires a legal contract . I usually charge around $250 for such rights , or negotiate a percentage of sales . A well-known rail artist found out his portraits of locomotives were being reproduced without permission by an unscrupulous dealer back East . Federal law enfiorcement descended .The artist was in the enviable position of offering a deal to this thief - a full compensation for the pirated art(about $25000) or an all-expense-paid five year vacation at Leavenworth , Kansas and a name-change to "Jennifer" thrown in as well.Guess which choice the dealer took ?
