All sorts of issues come to mind.

The first is if this is an issue of strict liability or if Negligence has to be shown.

Then the Forestry Services would need to show they mitigated their loss, did everything reasonable to minimise their loss, that could be why they are claiming a lower sum.

Of course it was not just the Forestry Service that had losses, some seem a bit remote, no doubt they will wait and see how this case goes.
