I hadn't seen your reply when I wrote mine. My wife (now reading over my shoulder) laughed and said part 92 expired in 2011 - those are noncurrent regs.
The EPA regs can be located in title 40, section 1033, and she says "See especially 40 CFR1033.1 for definition of manufacture date and 1033.5 for an interesting option to *request* exemption for non-standard gauge railroads."

FRA regs applicable are in Title 49, subtitle B and can be found at [

She also notes: Emission certification for a locomotive is applied for and held by the LOCOMOTIVE MANUFACTURER, NOT by the engine manufacturer.
Cat could sell them a D398 for all that it matters if the locomotive mfr. can figure out how to certify the locomotive as compliant with Tier 4.
